Question by Lynne C: can one legally change back to their maiden name as part of the divorce in Pennsylvania? my “lawyer” said no.

I believe she doesn’t want to process the extra paperwork, as she was originally obtained by my “husband”. she says it must be done seperately – after the divorce is final. But a friend said it all was done on the same day for her 15 years ago.

Mine was done at the same time. Extra paperwork??? It was line item 4 in my divorce paperwork and it was one sentence long. I think her lawyer is feeding her crap to just get more money out of her later to add an addendum to the divorce. She should get a second opinion as mine was not in PA.

Yes you can you need to talk to another lawyer you can get your name changed back to your maiden name.

Yes it must be done seperatly after the divorce is final and YOU have to do it. You have to contact Social Security, you have to change your driver’s license, any credit cards, any employment recoreds, all tax records, all loans, medical records for yourself and if you have children you will have to change your name on their records as well as their school records. What does something your friend had done 15 years ago have to do with your divorce in 2007? Laws change.

see that was 15 years ago ,since then laws have changed . So your best thing here would be to ask another lawyer . but when I got divorced it got put into the divorce agreement

Your lawyer is an idiot..You can put that in your divorce agreement,get your divorce amended so that you are referred to as Ms. whateveryournamewas.
Many people use alias’s also,so you can change your name on your checking accounts,and credit cards also. You have to do this yourself though,it won’t happen automatically.
I wish my ex wife would have changed her name back,I don’t like it that she is walking around with my name :( .

You do not have to, and they are right, it has nothing to do with the divorce. Just like when you were married, you went through the proper steps after you were married. Now, when you get divorced, you will reverse the process.

My ex would have changed her name back had it not been for our kids. She wanted to keep the same last name as them. I do not know what she will do if she remarries. But, not really my issue anyways.

It can be written in as part of the divorce agreement that you have your maiden name reinstated. Get another lawyer. As far as all of your important stuff (driver license, ss card, mailing name, blah blah blah) That you need to do on your own.

if you want your maiden name then your lawyer will have to do the little bit a paper work a.k. an extra paragraph in the divorce papers. that is all there is to it. get another lawyer if she does not abide by your wishes, make some free phone calls to other lawyers and ask the people who pick up the phone those secretary’s know alot.
