Question by MonaLisa: I filed a Probate. I am contesting a “Will” that is Blank.?
1. My brothers basically stole my Mothers Estate years ago.
2. A lawyer wrote them a letter and only then, did they produce the “Will” It was blank and a “roost” into getting her to sign all the documents. They wouldn’t take her to a lawyer. She was waiting.
3. One brother ripped the other brother off. He threaten him and he then gave him ,000.
4. The other brother continued in renting the property out for 00 per month for 3 yrs.
5. He then sold the property to another relative and pocketed the proceeds. The relative was well aware of them having my mother in signing the “grant deed” on her death bed.
6. The relative began losing the house. He made a deal with the Bank and he has moved.
7. I filed a “Probate” yesterday for the accounting of all proceeds of the Estate.
8. The Brothers had my mother to sign on her “Death Bed” a “Grant Deed, Will and Power of Attorney” ….. I know the Power of Attorney is Null and Voided at Death. I was told by others (that were there) that my brothers convinced her that she need to sign in order of preventing a long probate! And that my Mother trusted that my brothers would divide up things equally.
9. I searched the records. My brothers already had the property granted to them before! It was to get a loan for my Mother to pay her taxes. They never returned the property back to her, as agreed. (taking advantage of the elderly) or so I thought. …So in solidifying their crime (scared that they would be discovered) 2 months prior to her death they transferred the house back to her! This is why they never kept the appointments with the lawyer! Then they pretended to be non-the wiser and had her to sign another “Grant Deed” hours before her passing.
10. The Title Company did not take steps in investigating the prior grantor. (My Mother). The property was granted with “NO” consideration. (with an indication of fraud) I know that title company’s have a system in place that they run property’s threw. There is a “Flag” system, so in preventing lawsuits.
11. As of date, the mortgage company has not file putting the house into their name. (the market is flooded with so many foreclosure).
My question is….Lots of activity on this property. Can we record the Probate against the property, alerting anyone concern that the transfer is being contested and that the previous transfer was fraudulent. We have a lawsuit pending against my brother, the title company and the mortgage holder. How is the foreclosure stop?
I came out of the woodwork from the hospital. We were hit by a drunk driver. My Mother died of Pancreatic Cancer. She was diagnosis just months before her death.
I am not asking for legal advice.
There are thousands of people on Yahoo that have simple knowledge. And that knowledge is knowing of a specific “FORM” that I can record, putting persons on notice that “I AM HERE and that I HAVE A INTEREST” ….simple.

Your brothers seemed to be ‘at her death bed’, and also with her months before. Where were you and why are you coming out of the woodwork now?

Question by ervin_parker: Where’s the conservative outrage regarding “Death by Chocolate” desserts.?
Government bosses bite back at agency watchdogs
By The Associated Press
12.28.06
WASHINGTON — The inspectors general entrusted to unearth waste, fraud and abuse in federal agencies are increasingly under attack, as top government officials they scrutinize try to erode the watchdogs’ independence and authority.
During 2006, several inspectors general felt the wrath of government bosses or their supporters in Congress after investigations cited agencies for poor performance, excessive spending or wasted money.
For instance:
The top official of the government’s property and supply agency compared its inspector general to a terrorist, hoping to chill audits of General Services Administration regional offices and private businesses.
Directors of the government’s legal aid program discussed firing their inspector general, who investigated how top officials lavishly spent tax dollars for limousine services, ritzy hotels and “Death by Chocolate” desserts.
Administration-friendly Republicans in Congress tried to do away with the special inspector general for Iraq, who repeatedly exposed examples of administration waste that cost billions of dollars. Among the contractors criticized was Halliburton Corp., once headed by Vice President Dick Cheney.
The Pentagon has been making its inspector general use lawyers picked by the defense secretary instead of independently hired attorneys.
“It’s hard to believe that the government is serious about policing itself when it’s whacking the people who are actually minding the store,” said Danielle Brian, executive director of the Project On Government Oversight, a nonpartisan group that tracks government waste and fraud. “These people are our security officers who help guard tens of billions of dollars. It’s ridiculous to prevent them from doing their jobs.”
Sean Kevelighan, spokesman for the White House Office of Management and Budget, says the Bush administration counts on “independent and unbiased views” of the watchdogs and is willing to intervene in any disputes.
“If and when there are times where intervention is necessary, the administration will do so to ensure all the parties are educated about one another’s roles and the importance of maintaining a productive relationship — and a healthy respect for the responsibilities of all involved,” he added.
When GSA Inspector General Brian Miller’s team intensively audited the agency’s regional offices, he ran into strong resistance from agency administrator Lurita Doan.
A business owner, Doan suggested some auditing functions be taken away from the watchdog and given to small businesses.
“There are two kinds of terrorism in the U.S.: the external kind and internally, the IGs have terrorized the regional administrators,” she told Miller and his staff on Aug. 18.

Question by Rich: IRS Audit w/ IRS Attorney or fight it out in Tax Court?
I’m currently at the IRS attorney “disclosure” phase of an upcoming IRS Tax Court appearance. The IRS’ attorneys want to settle with me and disregard all of my Schedule A deductions. I cannot get a letter of reimbursement policy from a previous employer (nor can the attorneys). Would you go continue on to Tax Court and try to fight it out there, or just accept the offer from the IRS’ attorneys to settle? There is ZERO chance I’ll get anything resembling a letter or policy from the previous employer and is it worth fighting for my schedule A deductions without it???
Thank you!

Since employee expenses that are reimbursable are not deductible whether or not they’re actually reimbursed, if that’s the issue and you can’t get the statement from the employer you’re going to lose on that one, so probably not worth the extra time, expense and aggravation of going to tax court on it.
What do you think? Answer below!
